2.31 Rules for the Maintenance of Public
Order
The "Rules for the Maintenance of Public Order," contained
in section 6450 of the Law of the State of New York, apply to all members
and organizations of the College community as well as visitors and licensees.
These rules are incorporated in the "Statement of Responsibilities"
in section
7.1.2.3 of Volume VII of this Policy Manual.

A.

Individual student violations of the rules will be heard through
the College judicial system as constituted in sections 7.1.2.4,
7.1.2.5,
7.1.2.6,
and 7.1.2.7
of Volume VII of this Policy Manual. Individual faculty and staff
or administration violations handled by a specially convened hearing
committee will be composed of three members from the constituency
of the alleged violator and one member from each of the other constituencies.
Violations by noncommunity members will result in the offender's
immediate removal from the campus and possible prosecution.

The director of judicial affairs (or designee) will inform the
vice president for student affairs and campus life (or designee)
of alleged violations of the rules. The vice president for student
affairs and campus life (or designee) may request an investigation
to be conducted by the Office of Public Safety and, in extreme circumstances,
may charge the accused immediately and suspend the accused pending
the outcome of a hearing.

If formal charges are to be made as a result of the investigation,
a hearing will be held that will follow the procedures outlined
in section
7.1.2.5 in Volume VII of this Policy Manual. If the hearing
officer/board determines that a violation has occurred, an appropriate
sanction will be imposed. Appeals may be submitted in writing as
outlined in section
7.1.2.5 in Volume VII.

B.

The "Rules for the Maintenance of Public Order" are deemed
part of the bylaws of all organizations operating on College-owned,
-leased, or -operated property and shall be reviewed annually. Violations
of these rules by organizations will be heard by the associate vice
president for student affairs and campus life (or designee) and
may result in recision of permission for that organization to operate
on College-owned, -leased, or -operated property.

Appeals may be submitted in writing to the vice president for student
affairs and campus life (or designee).

If, in the judgment of the associate vice president for student
affairs and campus life, individual members of the organization
have violated the "Rules for the Maintenance of Public Order,"
the associate vice president for student affairs and campus life
shall make the appropriate referral to the director of judicial
affairs for action. In such cases, the procedures established for
adjudicating individual violations of these regulations shall be
followed.

C.

Any action taken by the College shall be in addition to any penalty
pursuant to the penal law or any other chapter to which a violator
or organization may be subject.

Note: An organization is defined as two or more members
of the Ithaca College community united for a common purpose. |
