When an incident occurs involving an allegation that a participant has violated the Summer Pre-College Rules below, Policy Manual Section 7.1.2.3.5 "Statement of Responsibilities”, or the Residential Life Rules and Regulations, the matter will be handled according to the following procedures:
Procedures for Addressing Program Conduct or Disciplinary Incidents
- The possession or use of alcohol and other drugs (including all forms of marijuana), fireworks, guns, and other weapons are prohibited.
- Overnight Summer Pre-College Students are not allowed to bring their vehicles to campus or operate a vehicle on campus.
- Commuting Summer Pre-College Students’ personal vehicles must adhere to College parking regulations.
- Summer Pre-College students may only leave campus under the direct supervision of Summer College personnel during the program.
- No violence, including sexual abuse or harassment, will be tolerated.
- Hazing of any kind is prohibited. Bullying including verbal, physical, and cyberbullying are prohibited.
- No theft of property, regardless of owner, will be tolerated.
- No use of tobacco products, illegal drugs, or controlled substances.
- Misuse of, or damage to, College property is prohibited. Charges will be assessed against those Summer Pre-College Students who are responsible for damage or misuse of College property and will be responsible for damage expenses.
- The inappropriate use of cameras, imaging, and digital devices is prohibited in violation of individuals’ reasonable expectations of privacy. This includes the use of such devices in showers, restrooms, and other areas where privacy is expected by individuals who may be under the age of 18.
1. Documentation
a. Incidents will be documented by Summer Pre-College staff, the Office of Public Safety, or other Ithaca College personnel and reported to the Director, Office of Extended Studies (or designee). Confidential resources listed on the SHARE website are not required to report information to program personnel or to the College’s Title IX Coordinator.
2. Allegations of Sexual Misconduct
a. Allegations of sexual misconduct include matters involving sexual harassment, non-consensual sexual activity, domestic/dating violence, and stalking.
b. Incident information will be handled in accordance with section 7.1.2.5 of the Student Conduct Code.
c. The Director, Office of Extended Studies (or designee) may implement interim measures immediately to protect the health, safety, and welfare of the parties or other members of the College community. Given the limited duration of the Summer Pre-College Programs and the normal length of a hearing process, pre-hearing interim measures may be the only remedial action taken for an allegation of sexual misconduct.
d. Written notice will be provided to the participant’s parents or legal guardians in accordance with section 4.
3. All Other Conduct Matters
a. In accordance with Section 7.1.2.7.5 of the Student Conduct Code the following procedure for conduct review in Summer Pre-College Programs will be followed:
i. The Director (or designee) will review the incident information and determine whether a conduct review meeting is necessary with the participant and any other involved parties.
ii. If a meeting(s) is necessary, advance written notification will be sent to the participant(s) and any other parties no less than 6 hours prior to their meeting. The advance written notification will include the section(s) of the Residential Life rules and regulations allegedly violated; the possible sanctions; and an appointed time to meet with the Director (or designee).
iii. The Director may implement interim measures prior to the meeting occurring, to ensure the safety and welfare of program participants and the overall College community.
iv. The conduct review meeting will result in one of the following possible outcomes, which will be determined by the Director (or designee):
a. The charge(s) may be dismissed.
b. The participant may accept responsibility for the alleged violation or may be found responsible and sanctioned by the Director based on a preponderance of the evidence standard. Sanctions can vary based on the offense and may include immediate dismissal from the program. Parents or legal guardians of participants dismissed from the program must retrieve participants from campus, or arrange for their departure to occur, within 12 hours of the dismissal.
c. In the event that the Director determines that additional information or further investigation is required, the outcome of the hearing will be delayed pending such investigation. The Director will follow up with the participant to arrange any additional meeting(s) that are needed and/or to apprise the participant of the progress of the investigation.
v. Written notice of one of the above outcomes, including the decision regarding responsibility and any resulting sanction, will be provided to the participant within 24 hours of the conduct review meeting and will be sent to the participant’s parents or legal guardians in accordance with section 4.
b. Appeal of All Other Conduct Matters
i. A participant found responsible and sanctioned for violating the Student Conduct Code may appeal the decision to the Associate Provost, Graduate & Professional Studies (or designee) no later than the day last day of the Summer Pre-College program. The appeal must be in writing and state the grounds for the appeal, which may include:
a. The sanction imposed was not appropriate for the violation of the Student Conduct Code and/or Residential Life rules and regulations.
b. New and relevant evidence is available that was not reasonably available at the time of the conduct review meeting and that could materially affect the outcome.
iv. All sanctions applied by the Director (or designee) remain in effect pending the outcome of the appeal.
v. The decision of the Associate Provost (or designee) on the appeal is final.
4. Communications with Parents or Legal Guardians
a. If a participant is accused of any conduct violation, their parents or legal guardians will be notified by program personnel. Program email communications to participants will be sent concurrently to parents or legal guardians, including emails to schedule any conduct-related meetings. Email communications to participants, including emails to schedule any conduct-related meetings, may originate from the Director (or designee), Office of Public Safety personnel, or other authorized College personnel.
b. For matters involving sexual misconduct, program personnel will also notify parents or legal guardians of participants who are alleged victims of the conduct. Note, however, that confidential resources listed on the SHARE website are not required to report information to program personnel or to the College’s Title IX Coordinator.
5. Refunds
a. No refunds of application or program fees are issued nor are early departure travel-related costs reimbursed for participants involved in conduct review or based on interim measures/sanctions imposed by the College.
